1. Eligibility and authority
You must be at least 18 years old and legally able to enter a contract. If you use Side by Sides K9 for a business or organization, you represent that you have authority to bind it to these terms. Authorized staff and clients must use the service only through accounts and permissions provided to them.
2. Accounts and security
You are responsible for accurate account information, safeguarding credentials, limiting access to authorized users, and activity under your account. Tell us promptly if you believe an account or device has been compromised. We may suspend access when reasonably necessary to protect users, data, or the service.
3. Subscriptions and payment
Paid plans, included features, limits, and current monthly prices are described on our Pricing page or in a written order. Subscription fees are billed according to the selected plan and are nonrefundable except where required by law or expressly stated in writing.
We may change plan pricing or packaging with advance notice. Continued use after a change takes effect constitutes acceptance. Enterprise services, migrations, integrations, and onboarding may be governed by an additional written order.
4. Customer data and responsibilities
You retain ownership of information, photos, videos, records, and other content you submit. You grant Side by Sides K9 the limited rights needed to host, process, transmit, back up, and display that content to provide and protect the service.
You are responsible for the legality, accuracy, and integrity of your content and for obtaining required permissions and consents from staff, clients, pet owners, and other people. This includes permission to store contact details, care and training records, photos and videos, forms, and to send email or SMS communications.
5. Acceptable use
You may not use the service to violate law or third-party rights; send unlawful or deceptive messages; upload malware or harmful content; probe or bypass security; access another organization's information without authorization; interfere with service operation; resell access without permission; or reverse engineer the platform except where law expressly allows it.
6. Platform ownership
Side by Sides K9 and its licensors own the service, software, design, branding, documentation, and related intellectual property, excluding customer data. These terms provide a limited, nonexclusive, nontransferable, revocable right to use the service during an active subscription.
7. Third-party services
The platform may rely on third-party hosting, storage, authentication, communications, app-distribution, or integration services. Their availability and terms may affect some features. Side by Sides K9 is not responsible for third-party products outside our control.
8. Availability and changes
We work to provide a reliable service but do not guarantee uninterrupted or error-free operation. Maintenance, security needs, internet conditions, device limitations, or third-party outages may affect availability. We may improve, replace, or discontinue features while taking reasonable steps to avoid unnecessary disruption.
9. Suspension and termination
You may stop using the service and cancel according to your subscription terms. We may restrict or terminate access for nonpayment, unlawful use, material breach, security risk, or conduct that harms the service or others. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, and payment obligations—will survive.
10. Disclaimers and liability
The service is provided “as is” and “as available” to the fullest extent permitted by law. Side by Sides K9 disclaims implied warranties, including merchantability, fitness for a particular purpose, and noninfringement.
Side by Sides K9 is an operational software platform and does not provide veterinary, medical, legal, tax, or professional animal-care advice. Kennels remain responsible for animal care, safety, staffing, client decisions, and compliance.
To the fullest extent permitted by law, Side by Sides K9 will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, goodwill, or data. Our total liability arising from the service will not exceed the amount paid for the service during the 12 months before the event giving rise to the claim.
11. Indemnification
You agree to defend and indemnify Side by Sides K9 from claims, damages, losses, and reasonable costs arising from your customer data, your business operations, your violation of law or third-party rights, or your material breach of these terms.
12. Governing law and changes
These terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute must be brought in a state or federal court with jurisdiction in Georgia, unless applicable law requires otherwise.
We may update these terms as the service changes. The revised version will be posted here with a new effective date. Continued use after the updated terms take effect means you accept them.
